A Trademark Lawyer Explains How To Avoid Seller Complaints

Fri Oct 22, 2021 Amazon Trademarks

Complaints can derail a business that sells on Amazon. Even companies with a solid reputation may face suspension due to complaints made against them. To prevent this, sellers can take proactive steps to keep their business active and their reputation intact. Our trademark lawyer explains some of these proactive measures.

Stay On Top Of Your Customer Performance Metrics

Customer performance metrics are a key piece of information that Amazon uses to determine whether or not a seller account should remain in good standing. Constantly reviewing this information enables sellers to decide what areas they excel in and what areas need work. By concentrating on the areas that need more work, Amazon sellers can avoid seller complaints. Some of the metrics Amazon tracks are:

  • Order Defect Rate: This is a ratio determined by the number of orders that have defects according to Amazon standards and the total number of orders filled. It is generally limited to a specific period of time.
  • Rate of Cancellation Prior to Order Fulfillment: This number is based on how many orders you actually fill versus how many orders are placed.
  • Perfect Order Percentage: This is the number of orders filled without any complaint of any kind.
  • Late Shipping: Items being shipped late reflect poorly on seller performance.

Be Authentic

A business must sell authentic products on Amazon. Knock-offs or imitation products will cause seller complaints to skyrocket. The best way to prove that the items being sold are genuine is to retain the invoices from where they are purchased. Also, be sure that the item’s description on Amazon is a true reflection of the product being sold.

Do Not Commit Intellectual Property Violations

Intellectual property violations are a growing cause of complaints lodged against sellers. While many of these complaints are frivolous and without merit, Amazon may still suspend the seller rather than take the time to investigate the actual complaint. When this happens, it is in the seller’s best interest to consult with a trademark lawyer

Some precautions sellers can take to prevent allegations of copyright infringement includes:

  • Be careful not to sell a product that can lead to an IP infringement claim. If you are unsure, avoid selling the product.
  • Do not use copyrighted images or trademarks without the proper authorization.
  • Adhere to all terms of the contractual agreement to sell that you entered into with Amazon.
